i am aware that webpagetest is an open source code but I would like to ask you if it's not prohibited to use your own private instance as a backend for your own site. basically i am going to measure a lot of things on my site, one of which will be site performance and I would like to integrate my site with the private instance running on was, some people might be paying for some of our services tho

The code is all under a BSD license (except for some of the libraries which may be GPL) and is about as liberal as you can get. You can do anything you want with it and several companies use the underlying agent technology as part of their testing infrastructure.
